1. Who we are
Hubbub is provided by Growthology Technologies LLP, a limited liability partnership registered in India (LLPIN ACD-7804), with its registered office in Mumbai, Maharashtra, India. Hubbub is an endorsed brand of SmallBigGrowth. In these Terms, “Hubbub”, “we”, “us” and “our” mean Growthology Technologies LLP.
These Terms of Service (the “Terms”) govern your use of the Hubbub website at hubbub.smallbiggrowth.com, the Hubbub application and any related services (together, the “Service”). Our Privacy Policy explains how we handle personal data and forms part of these Terms.
2. Accepting these Terms
You accept these Terms when you create an account, or when you use the Service, whichever happens first. If you do not agree, do not create an account or use the Service.
Using Hubbub for a business. Hubbub is a business tool. If you use it for a company or other organisation, you confirm that you have authority to accept these Terms on its behalf, and “you” means both you and that organisation. If you are a solo founder, freelancer or other individual using Hubbub for your own trade or profession, you accept these Terms in that business capacity.
Age. You must be at least 18 years old, and old enough to enter a binding contract where you live, to use the Service. The Service is not directed at children. If we learn that an account belongs to someone under 18, we will close it and delete its data.
Mandatory rights. Nothing in these Terms removes rights you have under laws that cannot be excluded by contract, including consumer protection laws where they apply to you.
3. What Hubbub does
Hubbub watches publicly available online discussions, starting with Reddit, for conversations that match the business and audience you describe. It scores those conversations for relevance, suggests draft replies written in the voice you set, and shows mentions of your brand.
A person always posts. Hubbub never posts, comments, votes or sends messages on any platform on your behalf. You decide whether to use a draft, you can change it, and if you choose to post it you do so yourself, from your own account.
AI-generated output. Scores, summaries and drafts are produced automatically, partly by artificial intelligence. They can be inaccurate, incomplete, out of date or unsuitable for a given community. Read and check every draft before you use it.
Public sources change. What the Service can find depends on content that third parties publish and control. Posts may be edited, deleted or become unavailable, and platforms may change how their content can be accessed. We may change the sources and methods we use at any time.
Changes to the Service. We are building Hubbub actively. We may add, change or remove features, and we may offer early or beta features that are provided as they are and may be withdrawn. If we remove a core feature you are paying for, we will tell you in advance where reasonably possible.
4. Your account and team
- Give us accurate information when you sign up and keep it up to date.
- Keep your password secret. You are responsible for everything done through your account. Tell us straight away at hubbub@smallbiggrowth.com if you think someone has accessed it without permission.
- The person who creates a workspace is its owner. The owner can invite teammates and give them roles, and is responsible for making sure everyone they invite follows these Terms.
- One person, one login. Do not share an account between people.
5. What you post is yours to answer for
Because you post, not us, you are solely responsible for everything you publish, including text you took from a Hubbub draft. In particular, you are responsible for:
- following the terms, content policies and rules of each platform you use, including Reddit’s User Agreement and Content Policy;
- following the rules of each community you post in, including any rules on self-promotion, links and disclosure;
- clearly disclosing your connection to your company or product whenever you mention it, and complying with the advertising, endorsement and consumer protection laws that apply to you;
- your accounts on third-party platforms, and anything that happens to them; and
- making sure what you post is accurate, lawful and does not infringe anyone’s rights.
Platforms and moderators decide what stays up. We do not control, and are not responsible for, whether a community accepts, removes, ranks or responds to your posts, or whether a platform restricts or suspends your account.
6. Acceptable use
You must not use the Service, or anything it produces, to:
- send spam, or post repetitive, bulk or unsolicited promotional content;
- manipulate votes, karma, rankings or engagement, or ask others to do so;
- astroturf: pose as an independent or unconnected customer, run multiple or fake accounts (sockpuppets), or hide your affiliation where it matters;
- create, buy, sell, rent or “farm” accounts on any platform;
- harass, threaten, bully, defame or discriminate against anyone, or publish anyone’s private information;
- impersonate any person or organisation, or make misleading claims;
- build profiles of, track, or collect personal information about the people whose posts appear in Hubbub, or contact them outside the public conversation they started;
- evade a ban, suspension or restriction imposed by a platform or community;
- break any law, or any platform’s terms of service; or
- publish anything unlawful, infringing, fraudulent or harmful.
You must also not:
- scrape, crawl, copy or extract data from the Service by automated means, except through features we provide for that purpose;
- reverse engineer, decompile, disassemble or try to derive the source code, models or prompts of the Service, except to the extent the law allows despite this restriction;
- probe, test or breach the security of the Service, or interfere with its operation, for example by overloading it or introducing malicious code;
- get around usage limits, plan restrictions or access controls;
- resell, sublicense or provide the Service to others as a service bureau without our written permission; or
- use the Service to build or benchmark a competing product.
We may investigate suspected breaches, remove access to content and take the steps described in section 11.
7. Your content and outputs
Your content. “Your Content” means what you give us: your website address, product and audience descriptions, keywords, voice settings, edits, notes and messages. You keep all rights in Your Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, copy, process and display Your Content only as needed to provide, secure, support and improve the Service, and as described in our Privacy Policy. You confirm you have the rights needed to give us Your Content and that our use of it as described will not infringe anyone’s rights.
Outputs. As between you and us, you own the drafts and other outputs the Service generates for you, to the extent any rights exist in them, and you may use them for your business. Outputs are generated by software, so other users may receive similar outputs, and we do not promise that an output is unique or free of third-party rights.
Other people’s posts. Posts from online communities that appear in Hubbub belong to their authors and are subject to the terms of the platform they came from. We show them so you can decide whether to join the conversation. Do not republish or reuse them except as the law and those platform terms allow.
Service data. We may collect and use data about how the Service is used, and aggregated or de-identified information derived from it, to operate, secure and improve the Service. We do not sell Your Content.
Feedback. If you send us ideas or suggestions, we may use them freely and without any obligation to you.
8. Privacy and data processing
Our Privacy Policy explains what personal data we collect and how we use it. Where we process personal data on your behalf as your processor, for example details of teammates you invite or personal data you include in Your Content, we do so on your instructions as set out in these Terms. If you need a data processing agreement, for example under the GDPR or UK GDPR, email us at hubbub@smallbiggrowth.com and we will provide one.
9. Free trial
New workspaces start with a free trial, currently 14 days, with no payment card needed. The trial may include usage limits. We may change, limit or end trial offers, and we may refuse or end a trial we reasonably believe is being abused, for example through repeated signups.
When a trial ends without a paid plan, the workspace is locked. Your data is kept, but you cannot view or use it until you choose a paid plan, subject to the retention rules in our Privacy Policy. You can delete your workspace or account at any time.
10. Payments and refunds
Merchant of Record. Paid plans are sold through our payment provider, Dodo Payments, which acts as our Merchant of Record and authorised reseller. When you buy a plan, you buy it from Dodo Payments, and its buyer terms apply to the purchase. Dodo Payments handles checkout, payment, invoicing and applicable sales taxes such as VAT and GST. We never receive or store your full card number.
Plans and renewal. The price, billing period and applicable taxes are shown at checkout. Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time, and cancellation takes effect at the end of the current billing period.
Refunds. Because the free trial lets you try the Service before paying, payments are not refunded, including your first payment, renewals and partial billing periods. If we charge you in error, we will correct it. The full policy is on our Refund Policy page, which forms part of these Terms. For any billing question, contact us first at hubbub@smallbiggrowth.com and we will work with our payment provider to resolve it.
Price changes. We may change our prices. We will tell you at least 30 days before a new price applies to your subscription, and it will apply from your next renewal. If you do not want to continue at the new price, you can cancel before then.
Failed payments. If a payment fails or is reversed, we may limit, lock or suspend paid features until it is resolved.
11. Suspension and termination
By you. You can stop using the Service at any time. The account owner can delete a workspace or the whole account from within the product. Deletion removes the data as described in our Privacy Policy and cannot be undone once complete.
By us. We may suspend or end your access to all or part of the Service if:
- you seriously or repeatedly break these Terms, including section 5 or section 6;
- your use creates a security, legal or reputational risk for us, other users or third parties;
- payment is overdue;
- we are required to by law or by a platform we depend on; or
- we stop offering the Service, in which case we will give you reasonable notice.
Where it is reasonable and lawful, we will tell you before we act and give you a chance to fix the problem. We may act immediately for serious breaches, or where notice could cause harm.
What survives. When your access ends, your right to use the Service ends too. Sections that by their nature should continue, including sections 5, 7, 14, 15, 16, 18 and 19, survive.
12. Our intellectual property
The Service, including its software, design, text, models and prompts, and the Hubbub name, Bub and our logos, belongs to us or our licensors. Subject to these Terms, we give you a limited, non-exclusive, non-transferable and revocable right to use the Service for your business while your account is active. We keep all rights we do not expressly give you.
13. Third-party platforms and services
Hubbub is not affiliated with, endorsed by or sponsored by Reddit or any other platform whose content it shows. The Service links to and relies on third-party websites and services that we do not control. Their terms and privacy policies apply when you use them, and we are not responsible for them.
14. Disclaimers
To the fullest extent permitted by law, the Service and all outputs are provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy and non-infringement.
In particular, we do not promise that:
- the Service will find every relevant conversation, or that its scores are accurate;
- using Hubbub will bring you leads, customers, sales, traffic, sign-ups, upvotes, rankings or any other result;
- any community or platform will accept, keep or promote what you post, or will not restrict your account; or
- the Service will be uninterrupted, error-free or available at any particular time.
Nothing in the Service is legal, compliance or professional advice. You are responsible for deciding whether your use of it meets the rules that apply to you.
15. Limitation of liability
To the fullest extent permitted by law, neither party is liable to the other for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, goodwill or data, however caused, even if it was told such loss was possible. We are also not liable for any suspension, restriction or loss of your accounts on third-party platforms, or for the consequences of anything you post.
To the fullest extent permitted by law, our total liability arising out of or relating to these Terms or the Service, for all claims together, is limited to the greater of (a) the amounts you paid for the Service in the 12 months before the event giving rise to the claim, and (b) 100 US dollars.
These limits do not apply to your obligations under section 16 or to your payment obligations, and nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, such as liability for fraud, or for death or personal injury caused by negligence.
16. Indemnity
You will defend, indemnify and hold harmless Growthology Technologies LLP, its partners, employees and agents against any third-party claim, and the resulting losses, damages, fines, costs and reasonable legal fees, arising out of:
- anything you or your team post or publish, including content based on a Hubbub draft;
- your use of any third-party platform or community;
- Your Content; or
- your breach of these Terms or of any law.
We will tell you promptly about any such claim, let you control its defence (though you may not settle it in a way that admits fault on our behalf or binds us without our consent), and give you reasonable help at your cost.
17. Changes to these Terms
We may update these Terms from time to time. The version number and date at the top of this page show which version is current. If a change is material, we will tell you by email or in the product at least 30 days before it takes effect. Changes needed for legal reasons, or that only concern new features, may take effect sooner.
If you keep using the Service after a change takes effect, you accept the updated Terms. If you do not agree, stop using the Service and delete your account before the change takes effect.
18. Governing law and disputes
Governing law. These Terms and any dispute or claim arising out of or relating to them or the Service are governed by the laws of India, without regard to conflict of laws rules.
Talk to us first. Before starting any formal proceedings, contact us at hubbub@smallbiggrowth.com and describe the problem. Both sides will try in good faith to resolve it within 30 days.
Arbitration. Any dispute not resolved that way will be finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by agreement between the parties or, failing agreement, in accordance with that Act. The seat and venue of arbitration will be Mumbai, India, and the arbitration will be conducted in English. Hearings may take place by video where the arbitrator allows.
Courts. Subject to the arbitration clause, the courts at Mumbai, India have exclusive jurisdiction. Either party may apply to any competent court for urgent interim relief, for example to protect its intellectual property or stop misuse of the Service.
Individual claims only. To the extent the law allows, disputes will be resolved only on an individual basis, and not as a class, collective or representative action or arbitration.
If you are a consumer and the law where you live gives you the right to bring proceedings in your local courts, or to rely on mandatory local law, this section does not take that right away.
19. General
- Entire agreement. These Terms, the Privacy Policy and any terms shown at checkout are the whole agreement between you and us about the Service.
- Assignment. You may not transfer these Terms without our written consent. We may transfer them as part of a merger, acquisition, reorganisation or sale of assets, and will tell you if we do.
- Severability. If any part of these Terms is found unenforceable, it will be enforced to the maximum extent allowed and the rest will stay in effect.
- No waiver. If we do not enforce a right straight away, we do not give it up.
- Events beyond control. Neither party is responsible for failures or delays caused by events beyond its reasonable control, such as outages of internet or cloud services, changes by third-party platforms, natural disasters or government action.
- Notices. We will send notices to the email address on your account. You can send notices to us at hubbub@smallbiggrowth.com.
- Relationship. We are independent contractors. These Terms do not create a partnership, agency or employment relationship, and give no rights to anyone other than you and us.
- Language. These Terms are written in English. If we provide a translation, the English version prevails.
